Licencing Car Boot Markets

Description

Barnsley Council, as markets authority, is the owner of market rights. The rights also entitle the Authority to protection from anyone else seeking to establish a rival market.

The Authority will allow two charitable events per charity or voluntary group per year.

Eligibility

Potential market operators and/ or land owners. Charitable and voluntary groups should not allow the use of their land for markets held by commercial operators.

Procedure

Notify the Council of the intention to hold a market at least one month in advance.

Planning permission should also be sought.

Additional Notes

The Council will allow one-off, irregular markets to be held by charitable and voluntary groups acting specifically to provide funds for legitimate community purposes (ie, NOT for commercial purposes).

Such markets should be restricted to:

  1. No more than 2 events per community group per year.
  2. Any site should not be used for more than 2 market-type events per year, the timing of which should be well separated.
  3. The number of trading pitches, 'table tops' or 'car boots' at each market-type event should also be limited to 30.
  4. Held irregularly and the timing of which should be well separated.
  5. Sale of goods by people who are not traders and who are not servicing the sale of goods via vans and lorries or with professional stall equipment.
  6. Goods on sale not to include new goods as sold on the Council's own markets.

The Council will monitor such markets to ensure they do not contravene its policies.
