Kendray resident fined for not clearing up after her dog

A BARNSLEY woman whose dog fouled a grassed area near her home has been ordered to pay fines and costs totalling £190 by magistrates.

Janet Frostick, 36, of Gerald Road, Kendray, was issued with a £50 fixed penalty fine in January after an officer of the council’s Regulatory Services witnessed her dog foul while roaming unsupervised.  Despite a reminder letter being sent to her a few weeks later, this fine was never paid.

Frostick pleaded guilty to allowing her dog to foul designated land and failing to remove the faeces at a at Barnsley Magistrates Court on Thursday, 19 June. The prosecution was brought under the Dogs (Fouling of Land) Act 1996.

Magistrates fined her £75, ordering her to pay a contribution towards the council’s costs of £100, as well as a victim surcharge of £15.

Cllr Roy Miller, Cabinet spokesperson for Customer and Neighbourhood Services, commented that people who look after a dog must always be ready and able to clear up after their dog. 

He said: “I would hope £175 is enough to convince anyone with a dog that they must always make sure that their dog is supervised. Not seeing it foul doesn’t absolve people of responsibility. Also, there are many other problems that stray dogs can cause, including road traffic accidents, so owners should always make sure they are supervised at all times.

“If officers of the council’s Environmental Regulatory Unit witness a stray dog foul then they will trace the dog back to its irresponsible owners who will then receive a fixed penalty fine. The dog may also be seized as a stray and taken away to kennels.”
