TWO Barnsley men found themselves with a conditional discharge for 12 months and costs of £348.39 to be split between them, after Barnsley Magistrates Court found them guilty of neglecting their duty of care responsibilities for disposing of commercial waste.
In January an Environmental Regulatory Unit Field Officer of Barnsley Council’s Regulatory Services found a number of black bags fly-tipped to the rear of Shortwood Villas, Hoyland. The waste was traced to Take 2 Training on Victoria Street, Barnsley.
Martin Cooper, 40, of Midhope Way, Pogmoor, was found guilty at a hearing on July 10 of transferring 20 bags of commercial waste to Derek Bamforth, 49, of Worsbrough Road, Birdwell, who was not authorised to carry the waste.
Neither men completed waste transfer notes for the movement of waste. Mr Bamforth was found guilty of carrying waste without being authorised to do this.
The fly-tipping offence was not proven. Mr Bamforth claimed that he had taken the waste to a local skip company.
Cllr Roy Miller, Cabinet Spokesperson for Customer and Neighbourhood Services, said: “It looks like this was a case of people simply neglecting to make sure that the person disposing of their waste would do the job properly.
“I have no doubt Mr Cooper didn’t know that his waste would end up being dumped, but we have long publicised the need for people to make sure that they check who is carrying their waste. If they are not registered with the Environment Agency, don’t use them.”
