THE BARNSLEY METROPOLITAN BOROUGH COUNCIL (BARNSLEY MARKETS) COMPULSORY PURCHASE ORDER 2006

WHEREAS the Barnsley Metropolitan Borough Council have submitted to the Secretary of State for Communities and Local Government for confirmation an Order made by them under section 226 (1) (a) of the Town and Country Planning Act 1990, section 13 of the Local Government (Miscellaneous Provisions) Act 1976 and the Acquisition of Land Act 1981, which would authorise them to acquire compulsorily the land referred to in the Schedule hereto for the purposes of facilitating the carrying out of development, redevelopment or improvement which the Acquiring Authority thinks is likely to contribute to the achievement of the promotion or improvement of the economic, social and environmental well-being of the Barnsley Markets area by securing the provision of a mixed retail leisure and residential scheme with a replacement market, public amphitheatre/public space and multi storey car park (the Scheme) and new rights over land described in the Schedule hereto.

NOTICE IS HEREBY GIVEN that a conjoint public local inquiry into this matter and a proposed road stopping up order and improvement of parts, by the Secretary of State for Transport in accordance with section 247 and section 253 of the Town and Country Planning Act 1990 for Eldon Street, Kendray Street, May Day Green, Cheapside and Lambra Road, Barnsley South Yorkshire will be held by Mr David Nicholson RIBA IHBC at Barnsley Central Library, Shambles Street, Barnsley, S70 2JF on Wednesday 18 April 2007 at 10:00am.

A copy of the Order and of the map referred to therein are on deposit at the Council Town Hall, Church Street, Barnsley and at the Barnsley Connects Service Centre, County Way, Barnsley and may be seen there, on application at all reasonable hours.

 

SCHEDULE

A total area of 6.02105 hectares in Barnsley Town Centre (including the land over which new rights are to be sought), bounded by (and including in part) Kendray Street to the north, Harborough Hill Road to the east, Lambra Road to the south and Cheapside/May Day Green and rear of Burlington Arcade to the west.
The land is comprised broadly of two parts. The first being the Metropolitan Shopping Centre, Barnsley Market complex (indoor and outdoor markets) the Council office building and a former carpet warehouse site all  located between Kendray Street and the rear of Burlington Arcade, May Day Green/Cheapside and Lambra Road west of the existing railway line.
The second part of the land lies to the east of the railway line and is the former premises of CEAG located between Pontefract Road and Harborough Hill Road with access off Kendray Street beyond the level crossing with the railway line.
New rights for all purposes in connection with the Scheme are to be sought over 0.6384 hectares of land to include land comprised of the railway and land and buildings located at Burlington Arcade and May Day Green, part of the Alhambra Centre and land adjacent to Lambra Road as follows:
the right to enter and carry out any works necessary for the construction and use of the Scheme on the land to be acquired and/or such accommodation and other works as may be necessary to maintain, renew, remove, underpin and replace (as appropriate) new and existing premises, property, windows and doorways, service conduits, aerials, satellite dishes, venting and alarm apparatus and other plant and equipment, to alter or adapt the land and premises in order to render them compatible with the Scheme, to erect scaffolding and temporary hoardings, to erect tower cranes together with the right to swing the jib of a crane (loaded or unloaded) through the airspace above the said land and premises.
