Mandela Gardens - Public Path Stopping-Up Order

THE METROPOLITAN BOROUGH OF BARNSLEY (UNDEFINED FOOTPATHS)
(MANDELA GARDENS, BARNSLEY) PUBLIC PATH STOPPING-UP ORDER 2008


NOTICE IS HEREBY GIVEN that on the 10th June 2008 the Borough Council confirmed the above-named Order.

The effect of the Order as confirmed is to stop up the undefined paths which cross Mandela Gardens at the rear of the Civic Hall between Regent Street South and Hanson Street as shown on the Order map.

Alternative public footpaths will be provided for use as replacement routes across the site of the Mandela Gardens on realigned routes in order to maintain access from Regent Street South to Hanson Street and Eldon Street.

A copy of the Order and the Order map may be seen free of charge at the Barnsley Connects Service Centre, Civic Hall, Eldon Street, Barnsley during normal business hours, Mondays to Fridays.  Copies may be purchased for a small charge. 

The Order comes into force on the date on which the Council certifies that the provisions of Article 2 of the Order have been complied with  but if any person aggrieved by the Order desires to question its validity or that of any provision contained in it on the ground that it is not within the powers of the Town and Country Planning Act 1990, or on the ground that any requirement of that Act or of any regulation made under it has not been complied with in relation to the confirmation of the Order, he or she may apply to the High Court for any of those purposes under section 287 of the Act within six weeks from the date on which this notice is first published as required by paragraph 7 or 8 of Schedule 14 to that Act.
