Conservation Areas

A Conservation Area is one that is designated by the Local Planning Authority because of its special architectural or historic interest. This is judged to be of such high quality that its character or appearance must be enhanced or preserved.

Conservation Areas are often designated around historic town and village centres. Usually these areas are characterised by buildings with strong group value, created by consistent use of traditional forms and materials. Very often the areas include listed buildings, individually protected for their special historic or architectural interest. The high visual quality of these areas is often enhanced by mature trees and boundary walls.

New development in a Conservation Area will be permitted only if it is considered to enhance or preserve the character and appearance of the area. Proposals for new development should be submitted as full, not outline applications. They must include a design statement explaining and justifying the proposals, and drawings showing the scheme in its context, such as a street scene elevation.

In order to preserve the character of Conservation Areas there are strengthened controls, and these restrictions apply:

Demolitions

1. *Consent needed for demolition of buildings with a volume over 115 cubic metres

2. *Consent needed for demolition of walls, fences or gates over 1 metre high where adjoining a highway, or over 2 metres high elsewhere

Trees in Conservation areas

3.  6 weeks' notice must be given to the Local Planning Authority if it is proposed to fell, lop, top or uproot trees.

 In consevation areas permitted development can be carried out without planning permission, subject to certain conditions.

4. Permitted development for extensions to dwellings limited to 50 cubic metres

5. No permitted development for roof extensions to dwellings

6. No permitted development for cladding the exterior of dwellings

7. Permitted development for garden buildings is restricted to 10 cubic metres

8. No permitted development for satellite dishes on elevations fronting a highway or on chimneys

 Applications for Conservation area consent will be dealt with in a similar manner as a planning application.

Any proposals for development or demolition within Conservation Areas should be discussed with the Conservation Officer, telephone Barnsley (01226) 772576 or fax (01226) 772591

Proposals for work to trees in Conservation Areas should be discussed with the Forestry Officer, telephone Barnsley (01226) 772557

Charges/Fees

 There are no charges for general or pre-application advice.

There are no fees for Conservation Area Consent applications.

Planning applications in Conservation Areas are subject to normal scale of fees.

 Fees can be paid by cheque or cash at Barnsley Connects, The Civic, Eldon Street, Barnsley, S70 2JL.

All applications in Conservation Areas are advertised in the local press and at the site, and neighbours are notified. 21 days is allowed for representations. Most applications are determined within 8 weeks.

 Frequently Asked Questions

How do I know if my property is in a Conservation Area?
The locations of the 18 Conservation Areas in the Barnsley Borough are listed earlier. Each one has a plan that shows its boundary in detail. Information and copies of the plans are available from the Conservation Officer.

Can I replace my windows and doors?
If the property is a dwelling and not listed, these may be replaced without permission, even in a Conservation Area, because the work is permitted development. Because windows contribute so much to the appearance of a building, and the character of an area, it is recommended repair should be the preferred option and that any new windows follow the previous (or original) pattern and, ideally, material. Please contact the Conservation officer for further details.

Can I replace my roof slates or tiles?
If the property is a dwelling and not listed, these may be replaced without permission, even in a Conservation Area, because the work is permitted development. In order to preserve the appearance and maintain the group value of the area, it is recommended that new roofs repeat the originals in profile, colour and, ideally, material.

Would I be allowed to alter and extend my property?
Where a building is included within a Conservation Area, it does not mean it cannot be altered or extended. In addition to the usual planning standards that would be applied to control visual and residential amenity, applications for works to buildings in these areas will be successful only if they are considered to enhance or preserve the character of the area.

There will be cases where it is desirable to retain a building that contributes to the character of the area, and a new use and/or owner may need to be found. Changes would often be necessary to secure the retention of the building.

Conservation is not the same as preservation; it allows some controlled changes to promote the viable use of buildings in Conservation Areas.

Would I be allowed to demolish my property and re-develop its site?
If the building contributes to the character of the Conservation Area, the local authority will wish to see it retained and maintained. It will resist proposals for re-development and refuse applications for demolition.

There will be cases where a building of poor quality, which contributes little to, or even detracts from, the character of the area is proposed for demolition. Where this is agreed by the Local Authority, and an application for appropriate new development of the site is approved, the demolition and re-development applications will be processed together and their approvals linked by condition.

Are any grants available for work to buildings in Conservation Areas?
Usually the answer is no, but from time to time English Heritage provides grant aid for very specific areas, usually just a part of one Conservation Area. Owners of eligible properties will be notified by the Conservation Officer.
