Local Housing Allowance will affect tenants who rent from a private landlord and have a deregulated tenancy (tenancy entered into after January 1989), who, on or after 7 April 2008 either:
• make a new claim
• have a change of address
• have a break in their claim
The following cases will be exempt from Local Housing Allowance and will continue to have their Housing Benefit calculated under existing rules:
• Local Authority tenants
• Housing Association tenants
• Tenants who have a registered fair rent
• Tenancies that commenced prior to January 1989
• Protected cases such as supported housing provided by social landlords, charities or voluntary organisations
• Tenancies in caravans, houseboats or hostels
• Cases where the Rent Officer judges that a substantial part of the rent is attributable to board and attendance*
(* These cases will still be referred to the Rent Officer individually and depending on how much board and attendance is provided they may be exempt from Local Housing Allowance)
