Description

 

The Building Act 1984 contains provisions that enable Local Authorities to control demolition in the interests of the safety and amenity of the public and occupiers/owners of adjacent property.

If you wish to demolish a building or part of a building, you are required to notify the Local Authority in writing usually giving a minimum of 6 weeks notice. A copy of the notice should also be sent to the occupier of any adjacent building, and to the appropriate gas and electricity providers so that their services can be safely disconnected prior to any demolition work.

The Council will then normally issue a Demolition Notice specifying steps to be taken during the demolition works to maintain public safety and amenity.

Failure to give notice or to comply with the conditions on the Council's notice is an offence under the Act.

Any person intending to carry out demolition.

 

Procedure

If you wish to demolish a building or part of a building you must inform the Local Authority in writing as soon as possible. Relevant information can be provided on the Notice of Demolition form, which is available from: Highways and Engineering, Westgate Plaza One, Westgate, Barnsley, S70 9FA, PO Box 601 or by telephoning the Council on 01226 772009 or 772010.

There is a charge of £200.00 to process the Demolition Notice and monitor the site works

We normally ask for a cheque to be enclosed with the demolition form payable to 'Barnsley MBC'.

How can the customer help

 

You should provide a location plan (minimum 1:1250 scale) clearly indicating the buildings to be demolished.

You should provide as much information as possible and the form should be signed and dated.

You should enclose the correct payment with the form.

You should inform the Council as soon as possible if there are any changes to the information provided.

Response Times/Next Steps

 

On receipt of the Notice of Demolition form, the Council has 6 weeks to respond with a Demolition Notice specifying conditions under thich the demolition can be carried out. However, we will aim to do this within 4 weeks or earlier.
