Housing in Multiple Occupation: Mandatory Licensing

A House in Multiple Occupation (HMO) is defined as a property which is occupied by at least 3 people who form 2 or more households who share one or more basic amenities such as a kitchen, toilet or bathroom. (The actual definition is under section 254 of The Housing Act 2004). Nationally, the general view is that HMOs contain some of the worst physical housing conditions and practices of housing management. It is also accepted that HMOs provide an affordable option for housing, which is in many circumstances is the only option for people on low incomes.

The Housing Act 2004 has introduced Mandatory Licensing for large high risk HMOs. These are defined as HMO's of three or more storeys which are occupied by five or more people who form two or more households.

The person having responsibility for the management of the HMO must apply for a licence. Where an application is made, the authority must grant the licence if it is satisfied that the house is reasonably suitable for occupation by a specified number of people, or that it can be made suitable by the imposition of conditions. The authority must also be satisfied that the proposed licence holder is a fit and proper person and is the most appropriate person to be the licence holder.  The cost per property/licence is £335.  There is a reduction to £225 for Licence Holders who are members of Barnsley's Accreditation Scheme. Licences are not transferable.  Cheques must be enclosed with the application form and made payable to Barnsley M B C.

On receipt of a completed application, a visit will be made to the house to establish suitability, and to assess which amenities or repairs, if any, are required as conditions. Customers or their agent must be able to accompany the officer during the licensing visit.  Access will be required to all rooms in the house. Tenants must be given at least 24 hours notice before entry.

A fire safety scheme will be produced and submitted to the Local Fire Authority for consultation and suitability.
