RE-ROOFING WORKS
A Building Regulations application is now required for all re-roofing works, even where the roof covering is being replaced by one that is less than 15% heavier or lighter than the original.
Previously, an application would only have been required where a roof covering was being replaced by one that was more than 15% heavier or lighter than the original to cover the structural aspects of the work. However, since April 2006, where an application is not required for structural works, one is still required for the renovation of the thermal insulation, i.e. insulation works. Technical Sheet No 9, which is available to download, gives further clarification of where an application is required.
A fee is still payable upon deposit of an application, but this is based upon the cost of providing the insulation and any new layer, such as felt, but not the roof covering itself.
Once a Building Regulations application has been submitted and we have received notification that works have started, a Building Control Officer will visit site to discuss the works being carried out and advise on any works that may be required to comply with Building Regulations. On successful completion of the works, a final inspection will be carried out and a Completion Certificate issued to the applicant. This will confirm that the works are deemed to have met the relevant requirements and this information is then recorded on our systems as such.
This latter point may be of particular importance to the owner, as it will affect the outcome of any searches or enquiries made against the property which are typically carried out when a property is sold, re-financed and when an insurance claim is made.
Throughout this process, we will offer advice and guidance to ensure that contractors do not inadvertently find themselves failing to meet the requirements of the regulations. Where there is a failure to submit an application or where a contravention has not been rectified the Council has a duty to take legal proceedings through the Magistrates Court where if convicted can lead to a fine of up to £5000 per contravention plus £50 per day that the default continues (Section 35: Building Act 1984).
