Article: Licences - Personal Licences Article Body A Personal Licence is required by any person selling alcohol by retail in a premises that has a Premises Licence allowing the sale of alcohol. Every supply of alcohol must be either made or authorised by a Personal Licence holder. A person applying for a Personal Licence must be at least 18 years of age and must usually live within the borough boundary. Applicants must complete both the application form and the disclosure of convictions and declaration form. They must also hold a recognised training qualification and must submit their qualification certificate; a criminal conviction certificate; or a criminal record certificate, which must be no more than four weeks old. Two passport-sized photographs, one of which is endorsed as a true likeness of the applicant, must also accompany the application. The fee for a Personal Licence is £37. The licence will be valid for ten years and is recognised throughout England and Wales. It is important to note that unless the application forms are correctly completed and are accompanied by the appropriate Criminal Record Bureau (CRB) check, licensing qualification, training certificate and licence fee, then your application may be rejected and returned to you. Once you have done this, you must also notify the council's Licensing Section of the loss or theft in writing, quoting the police reference number and enclosing a replacement licence fee of £10.50 (your cheque should be made payable to Barnsley MBC). A replacement licence will be issued to you by post. The application process is as follows: Complete and sign the application form ( Application for a Personal Licence). The application may be typed or written legibly in black ink. You must be at least 18 years of age to make this application and ordinarily resident within the borough of Barnsley. Provide two photographs of the applicant. They must be on photographic paper, both measuring 45 x 35 millimetres. The photographs must be taken against a light background so that the applicant's features are distinguishable and contrast against the background. The photographs must be full face, uncovered and without sunglasses and, unless the applicant wears a headcovering due to their religious beliefs, without a headcovering. One photograph must be endorsed as a true likeness by the Chief Executive to the Licensing Justices for the licensing district, a solicitor or notary, a person of standing within the community such as a bank or building society official, a police officer, a civil servant or a minister of religion, or any individual with a professional qualification. A full list of acceptable persons may be obtained from the council or you may call us to check the intended signatory is acceptable. Enclose a completed disclosure of criminal convictions and declaration form. Enclose the fee of £37 by cheque payable to Barnsley MBC. Enclose your licensing qualification (usually an accredited licensing qualification, for example British Institute of Innkeeping Awarding Body (BIIAB Level 2 National Certificate for Personal Licence Holders or 'Goal' Level 2 National Certificate for Personal Licence Holders. Both qualifications are accredited by the Qualifications and Curriculum Authority (QCA). Enclose a criminal conviction certificate or a criminal record certificate or the results of a subject access search of the Police National Computer by the National Intelligence Service. Such certificates or search results shall be issued no earlier than one calendar month before the giving of the application to the council. CRB will provide advice about umbrella bodies who will be able to process the appropriate disclosure check. A subject access search may be obtained through the South Yorkshire Police Data Protection Officer. Forms can be obtained by telephoning 0114 2 20 20 20 (24 Hour voicemail facility) and leaving your name and address, or by calling personally at police headquarters, South Yorkshire Police headquarters, Snig Hill, Sheffield, S3 8LY. The cost of this service is currently £10. An alternative is to contact Disclosure Scotland who are prepared to undertake basic checks. If it appears to the council that the applicant has been convicted of any relevant offence or foreign offence, the council must give the Chief Officer of Police for its area a notice to that effect. If the chief officer is satisfied that granting the licence would undermine the crime prevention objective, he must, within the period of 14 days beginning with the day he received the notice issue an "objection notice". If the chief officer of police does not withdraw the objection notice then the council must hold a hearing to consider the objection notice. The council may reject the application if it considers it necessary for the promotion of the crime prevention objective to do so, or grant the application in any other case. The licence will generally last for ten years. It will be in two parts, similar to the new type of DVLA Driving Licence. One part of the personal licence will measure not more than 100mm x 70mm, be of a durable material and include a photograph of the holder, name and address of the holder, a unique number, details of the council issuing the licence along with an identifier of that authority, and an expiry date. The second part will be in paper form and will contain similar information as mentioned above, but will not contain a photograph of the holder. This part must also contain details of any relevant or foreign offence (if any), the date of conviction and sentence imposed.
