Under the Licensing Act 2003, premises can be any place including a building, a moveable structure, an open space, a vehicle or vessel. Apply for a new Premises Licence Premises Licence Applications Variation of a Premises Licence There may be reasons whereby a person may wish to vary a Premises Licence. A variation may be, for example, to include further licensable activities, alter the operating times of existing licensable activities allowed by the licence, or to remove or change any of the licence conditions. The council may also require operators of licensed premises to make an application for a variation if an alteration or extension to the premises is being sought. Applicants are encouraged to discuss their proposals with a member of the Licensing Section before submitting an application. Premises Licence Variations Minor variations This legislation now allows Premises Licence holders to apply for minor variations to their licences in certain cases. For example, it is possible to make minor changes to the layout of a premises or to add some activities to a licence, such as regulated entertainment, provided that the variation does not have an adverse effect on any of the licensing objectives. Premises Licence Minor Variations Transfer of Premises Licences The Licensing Act 2003 allows a Premises Licence to be transferred to another person/company. This is usually made when the premises has been sold from one person/company to another. A transfer of the licence only changes the identity of the holder of the licence and does not alter the licence in any other way. Transfer of Premises Licence Variation of Designated Premises Supervisor (DPS) In every premises licensed for the supply of alcohol, a Personal Licence holder must be specified as the Designated Premises Supervisor (DPS). This will normally be the person who has day-to-day responsibility for running the premises. Vary a Designated Premises Supervisor Removal of requirement for a Designated Premises Supervisor (DPS) - Community premises only As of the 29 July 2009 new legislation has been introduced to be included in the Licensing Act 2003. This involves village halls and community premises such as church halls, chapels (and parts thereof). This change will enable community premises to operate without a DPS and for sales of alcohol to be made on such premises without the authorisation of a Personal Licence holder. Removal of Requirement for a DPS Interim authority notice The Licensing Act 2003 provides special arrangements for the continuation of permissions under a Premises Licence when the holder of a licence dies suddenly or becomes bankrupt or mentally incapable. Interim Authority Notice Notification of interest A person (which will include a business or company) with a property interest in any premises may give notice of their interest to the council using a prescribed form and on payment of a fee. Registration is discretionary and not therefore a legal requirement. Notification of Interest Provisional statement Where premises are being, or are about to be, constructed or altered, applicants may apply for a provisional statement, which acts as an indicator whether a Premises Licence is likely to be granted upon completion of the construction work or alterations in accordance with the plans. Provisional Statement Premises Licence holder change of name/address The holder of a Premises Licence must, as soon as is reasonably practicable, notify the council of any change in their name or address. Change of Holder Name and Address Premises change of name Should the licensed premises change its name, the council must be notified. Change of Premises Name Review of Premises Licence From time to time there may be difficulties with certain licensed premises that may be in breach of one or more of the licensing objectives: Prevention of crime and disorder Prevention of public nuisance Public safety Protection of children from harm This may require the Premises Licence to be reviewed. A review of a Premises Licence may be called by any of the responsible authorities, for example the police, Trading Standards, or by an interested party such as a resident or person running a business in the vicinity of the licensed premises. When crime and/or disorder occurs at or near licensed premises, it is the responsibility of the police to deal with those types of incidents. You may call 999 only if you consider the incident an emergency. If you do not consider the matter an emergency then you should call 0114 2 20 20 20, or Crimestoppers on 0800 555 111. EU Services Directive EUGO Portal The EU Services Directive was implemented on 28 December 2009, providing online access for the electronic submission of applications and other documentation without the need for a 'wet' signature. Those licence formalities above, that are within scope of the directive, will provide a direct link to the relevant web pages for making an online application. If you are setting up/running a business in the UK, but are based oversees from another EU state, you may find the UK welcomes business licence and regulation tool useful, in addition to the council's own web pages. Members of the public may still download the application forms on our web pages and hand them into the Barnsley Connects office, making the appropriate payment; or post them with the appropriate fee if they prefer. If an online application requires you to serve copies to responsible authorities, the council will, within one working day, serve copies on all relevant responsible authorities on your behalf.
