MODIFICATION ORDER (NO. 18) 2022

On 13 March 2023 Barnsley Metropolitan Borough Council confirmed the above-named Order, the effect of which is to modify the Definitive Map and Statement for the Penistone area by:-

i) Upgrading a section of Penistone footpath 82 to bridleway, commencing on the A628 Manchester Road at Thurlstone and proceeding generally south east to its junction with Penistone footpath no. 42 at Penistone Recreation Ground, as shown between points A, B, C, D and E on the Order map (SE 20 SW 2364 0348 2413 0336)

ii) Upgrading a further section of Penistone footpath 82 to bridleway, commencing at the eastern boundary of Penistone Recreation Ground and proceeding north east to its junction with the adopted vehicular highway at Stottercliffe Road, as shown between points F and G on the Order map (SE 20 SW 2431 0334 2438 0337)

iii) Removing a section of Penistone footpath 82 from the Definitive Map and Statement, commencing at the western end of the adopted vehicular highway at Stottercliffe Road and proceeding south east, as shown between points G and H on the Order map (SE 20 SW 2438 0337 2446 0335)

The Order and the Order map may be seen free of charge during normal office hours at the Library @ the Lightbox, 1 The Glassworks, Barnsley, at Penistone Branch Library High Street Penistone during normal opening hours.

The Order took effect on 13 March 2023 but if any person aggrieved by it desires to question its validity on the ground that the Order is not within the powers of Section 53 of the Wildlife and Countryside Act 1981 or that any of the requirements of Schedule 15 to that Act have not been complied with in relation to it, he may within 42 days from the date of publication of this Notice make an application to the High Court under paragraph 12(1) of the said Schedule 15.
