Article Body

The Local Land Charges Service has a vital role to play in protecting the financial and legal interests of prospective purchasers of land and property by providing information on land and property and giving access to the Local Land Charges Register.

The Local Land Charges Service is a statutory function within the council and as part of that function we make the Local Land Charges Register available to anyone who wishes to inspect it in person by way of a personal search.

The Local Land Charges Service is located in a non public access building therefore any correspondence should be addressed to:-

PO Box 634
Barnsley
S70 9GG

Telephone: 01226 773054
Email: locallandcharges@barnsley.gov.uk

What is a personal search?

A personal search is a search in the Local Land Charges Register which, if carried out in person is free of charge.

The information made available by carrying out this type of search is the same as that given on the LLC1 part of the Local Authority Search but the customer does not receive anything in writing.

How do I carry out a personal search?

The information is made available at the Civic, Eldon Street, Barnsley, S70 2JL, which is shown at number 10 on the Town Centre Map. The information is made available electronically for customers to view and take hand written notes.

Due to the way information is held it has been necessary to introduce an appointment system. To make an appointment contact the Local Land Charges team on 01226 773054. Appointments are available Monday toFriday. We have six two hour appointments per day, which will allow you to search on 16 addresses and two one hour appointments, which will allow you to search on eight addresses. You will be informed of the time of the appointment when booking.

Since 1 April 2010 the average waiting time for an appointment has been two working days.

The main customer group using this service are private search companies who are employed by solicitors or home information pack providers to gather the information for inclusion in a home information pack. If a personal search, rather than a Local Authority Search, is used and an error is made in extracting the information provided then the private search company, or their clients, would have no claim under Section 10 of the Local Land Charges Act, 1975 which relates to compensation for loss.

The following public registers are also available to view electronically at the Civic when carrying out a personal search. These are:

The Register of Common Land and Town or Village Greens
The Adopted Street Register
The Adopted Back Roads and Footpaths Register
The Definitive Map (Public Footpaths)
The Planning Register
The Enforcement and Stop Notices Register
The Unitary Development Plan
The Local Development Framework
The Register of Contaminated Land
The Food Premises Register
The Noise Abatement Zones Register

LLC1 and Component Data Searches

An LLC1 and Component Data Search allows customers to obtain all the information from the Local Land Charges Register, without having to carry out a personal search, and all the outstanding information on the Con29R part of the Local Authority Search that they have not been able to get from inspecting the other public registers but which is required for inclusion in a home information pack.

Alternatively customers may still carry out a personal search and a component data search.

How can an LLC1 and Component Data Search be obtained?

Postal searches

These should be submitted to Local Land Charges, PO Box 634, Barnsley, S70 9GG with a cheque for the relevant fee on our Postal LLC1 and Con29 Component Data Request Form which can be printed from here.

Email searches

Customers who use the service regularly are encouraged to set up an account for which they will be invoiced monthly in arrears. This will allow them to email requests using our Email LLC1 and Con29 Component Data Request Form, to a dedicated inbox and have the replies emailed back in a PDF format. To open an account the Terms and Conditions of Payment Form must be completed and returned to Local Land Charges, PO Box, Barnsley, S70 9GG.
