Smoking and licensed premises

England became smoke free from 1 July 2007 under the Health Act 2006. The law covers every licensed premises.

Licence holders may provide a facility for their customers to allow them to smoke. To do this you may need to:

• vary your premises licence
• seek an informal amendment to your plan of the premises

You may have to obtain a change to your planning permission. In some cases, you might also need permission from the Highways Authority for a pavement licence.
