Proposed changes to the hot food takeaway supplementary planning document and planning advice note

The Local Plan (adopted on Thursday 3 January 2019) contains policies to be considered when determining planning applications. Supplementary planning documents (SPDs) contain further advice and explain how these policies will be applied. In addition, planning advice notes (PANs) are used where there is no specific corresponding policy in the Local Plan. In this case the PAN gives guidance on how national planning policy is to be implemented locally.

A number of SPDs were adopted following the adoption of the Local Plan, including the hot food takeaway SPD and the supporting PAN.

We're seeking your views on draft changes to these documents during a consultation period  running from Monday 18 August to Monday 15 September 2025 at 5pm. Comments received will be considered when drafting the final versions.

Summary of proposed changes

Proposed updates are summarised in the tables below. Once adopted, the updated SPD and PAN will supersede the versions adopted in 2019.

Changes to the SPD

Changes to the PAN

2. Introduction Added reference to strategic commitments, and the role of the hot food takeaway SPD and PAN. This includes references to the Barnsley Council Plan 2024–2027, the Health and Wellbeing Strategy 2021–2030, and the Great Childhoods Ambition. Highlights Barnsley Council’s adoption of the Healthy Weight Declaration. Additionally, clarifies that hot food takeaways are no longer classified under a specific Use Class and will be assessed individually.
3. Policy Reflects the December 2024 update to the National Planning Policy Framework (NPPF). Advises that hot food takeaway applications should be refused if they are near schools or places where young people gather - unless located in designated town centres - or where there is evidence of negative health, pollution, or anti-social behaviour impacts. The updated NPPF also places greater emphasis on reducing health inequalities and promoting active lifestyles.
5. Health Updated with new statistics and references regarding obesity and associated health impacts in Barnsley. The data includes new references to national reports on the economic cost of obesity and long-term sickness. Updates the text relating to the link between the hot food takeaways and obesity.
6. Part 2 - Guidance Updates to reflect the December 2024 changes to the National Planning Policy Framework including additional reference to where young people congregate; and updates to the use classes with hot food takeaways no longer falling under Class A5. Outside the relevant centres it is proposed to change the school buffer zone from 400m to an increased walking distance of 800m. Clarifies that proposals for new hot food takeaways within this buffer and or within an 800m walking distance where young people congregate, will be refused.

Comments must be received by 5pm on Monday 15 September 2025.
