Two residents prosecuted for fly-tipping and waste offences

Two Barnsley residents have been fined and prosecuted for fly-tipping and waste offences after appearing at Barnsley Magistrates court.

In September 2024, our neighbourhood wardens investigated reports of fly-tipped waste on Station Road, Cudworth, with enquiries leading to Damon Milthorpe, aged 36 of Harold Avenue, Lundwood, being responsible for collecting and dumping the waste.

After failing to attend two previous court hearings, Mr Milthorpe was arrested at the end of April and pleaded guilty to the offences.

Mr Milthorpe was ordered to pay a total fine of £1,078 with the judge commenting that this offence was further aggravated by his advertising to take waste away without authority to do so.

A local business owner has also been prosecuted for failing in her duty of care in relation to controlled waste.

Leanne Lloyd of Leanne’s café at Park Rd, Barnsley, was unable to produce any written records of ‘waste and transfer’ notes relating to the proper transfer of controlled waste during an inspection conducted by wardens.

After pleading guilty, she was fined a total of £156.

Councillor Wendy Cain, Cabinet Spokesperson for Public Health and Communities, said:

“Alongside other recent prosecutions, these two fines show that we will not tolerate fly-tipping and a lack of duty of care when it comes to waste.

“Anyone who continues to fly-tip and blight our borough will be found, prosecuted and fined to send a message that we won’t tolerate this behaviour.

“When it comes to waste duty of care, we will always seek to support and encourage businesses on prevention and make them aware of their obligations in respect of waste, but where advice is ignored and legislation not complied with, breaches will be investigated and prosecutions sought.

“I’d like to thank our wardens, the Safer Communities team and our litigation team for their help and hard work in these prosecutions.”
