Smoking and licensed premises

From 1 July 2007 England became smoke-free under the Health Act 2006.

The new law covers every licensed premises. Premises licence holders may consider providing facilities for their customers to allow them to smoke. Depending on your individual circumstances, it may be that as a premises licence holder, you'll either have to formally vary your premises licence or seek an informal amendment to your plan of the licensed premises.

You may also have to obtain a change in your planning permission and in some cases obtain permission from the Highways Authority for a pavement licence.
